Extremely disappointing experience – I would avoid Irish Machinery Auctions

I purchased Lot 3472, a Hyundai Petrol Pole Chainsaw, from Irish Machinery Auctions (IMA) on 13 August 2026 and collected it on 14 August.

The lot was described simply as a “Hyundai Petrol Pole Chainsaw” and the photographs presented what appeared to be an intact machine. There was no clear indication that it was a non-functioning machine, a parts-only item or effectively a scrap-value item.

After collection and inspection, I discovered significant problems that were not adequately disclosed in the auction listing. The condition of the machine was substantially different from what I reasonably understood from the description and photographs.

Importantly, the price paid did not reflect the value of a non-functioning, parts-only or scrap item. Had the true condition been clearly disclosed, I would not have valued or bid on the machine in the same way.

I raised the matter with IMA and was particularly disappointed by the solution proposed by the manager. His solution was to put the machine back into the next auction at no additional fee.

I found this proposed solution unethical and, in my opinion, morally unacceptable, and I declined it.

It did not actually resolve the problem; it simply transferred the problem back to me and potentially placed another buyer in the same position. I would not be comfortable reselling the machine without fully disclosing its actual condition, which is precisely why I could not accept the proposed solution.

I fully understand that auction purchases involve buying used equipment and that buyers accept a degree of risk. However, there is a significant difference between buying used machinery with normal wear and buying an item that is effectively non-functioning or suitable only for parts, without that being clearly disclosed.

For me, the issue is not simply that I bought a faulty piece of used machinery. It is the combination of how the machine was represented, the condition in which it was actually received, the price paid in the circumstances, and the proposed resolution when I raised the complaint.

Based on this experience, I would strongly recommend avoiding Irish Machinery Auctions altogether. At the very least, potential buyers should inspect machinery thoroughly in person before bidding and should not rely on the auction photographs and description as an indication that an item is complete or functional.

A very disappointing experience from start to finish.

Bought few bits and pieces anything that was new was fine but nearly every tool Bought was scrap and non repairable .there was even tags on them from a tool repair shop stating that what was wrong and that they weren't repairable.when listing the items for sale these tags were discreatly tucked out of site.
The hidden charges you dont see also add up to more than the item your buying .if its used leave it there

There is a lot of scrap and lower-quality items sold here, but that’s generally what you expect when dealing with an auction. I don’t necessarily have an issue with that — it’s a case of buyer beware, and you also need to factor in the extensive fees added on top of the hammer price.

What I do have an issue with is the poor service and the way the auction process was handled. I placed the highest bid on an item and received an email confirming that I was the highest bidder but that the reserve had not been met. That was fair enough, and I was willing to increase my offer slightly.

However, as the auction had already closed there was no way to place another bid through the system, so I emailed them to say I was willing to go higher. I never received a reply. Later, I received another email saying that I had been outbid. Given that the auction had already closed and there was no way to place further bids, this does not appear to be a transparent or honest way of conducting an auction. If you are selling scrape, they could at least be honest about it. I have sent 4 emails since, absolutely no reply. So beware.. All they while still charging me €34 for the pleasure

For the benefits of anyone reading:
I got my money back via claim back from my bank. That is a fact. Another fact is clause 6 of the Irish machinery auctions terms and conditions. If anyone is in a similar situation to me with these cowboys here's some useful information:

1. Notify IMA Immediately
Email IMA as soon as possible — state the item was misrepresented/damaged/etc and you are exercising your right to rescind under Clause 6
Screenshot the listing immediately
Do not collect the goods

2. Chargeback Through Your Bank
If IMA refuse a refund, contact your bank and request a Visa chargeback for “Not as Described”
Must be raised within 120 days of the transaction
Provide: screenshot of listing, your emails to IMA, proof of non-collection, and a copy of Clause 6 of IMA’s T&Cs
If the merchant disputes it, insist on pre-arbitration and resubmit all evidence
If unsuccessful, get a Final Response letter from your bank — you’ll need it for Step 3

3. Complain to the FSPO (If Bank Fails)
File a complaint against your bank (not IMA) with the Financial Services and Pensions Ombudsman — www.fspo.ie
Free to use — argue the bank had clear evidence and failed to pursue the chargeback properly

4. Report IMA to Regulators
PSRA (regulates auctioneers, can withdraw licences) — www.psr.ie
If PSRA rejects your complaint, appeal to the Property Services Appeal Board (PSAB) — psabsecretary@psab.ie
CCPC (consumer watchdog, logs complaints for enforcement action) — www.ccpc.ie — Helpline: (01) 402 5555

5. Small Claims Court (Optional)
Claims up to €2,000, €25 fee — apply at www.csol.ie
Do not rely on consumer legislation — it has been found not to apply to auction sales
Instead, argue: breach of contract + Clause 6 of IMA’s T&Cs + Sale of Goods Act 1893, Section 13 (goods must match description)
If refused, you can appeal to Circuit Court within 14 days (€25) — but costs can be awarded against you at that level

Clause 6 — Your Key Lever
IMA’s own Lot Entry Terms and Conditions (Clause 6) state that the buyer has “the right to rescind the contract for the sale of the item if it has been materially misrepresented by reason of its condition, age or mechanical condition, but only if the Purchaser gives notice of same to the Auctioneer.”

These crowd are complete and utter cowboys. They operate in a grey area in the law. My experience of them is that they do not follow the consumer protection laws of this country. Product descriptions will not match the actual products being sold, they will hide behind the line that the person purchasing had an opportunity to inspect prior to the auction.
